Medidas de protección de la información y de los datos personales durante el Home Office

El pasado 11 de marzo, la Organización Mundial de la Salud (OMS) declaró como pandemia el virus COVID-19,1 esto tras la alta propagación del mismo. En México como en el resto del mundo, nos enfrentamos ante una situación sumamente delicada, y por lo cual se deben adoptar ciertas medidas para la salvaguarda de la integridad de la persona.
Ahora bien, de acuerdo con la OMS son las siguientes acciones que deben implementarse para comenzar a contener la propagación del COVID-19: lavarse las manos regularmente, evitar el contacto cercano con las personas; limpiar y desinfectar superficies y objetos de uso común en casas, oficinas, transporte, etc.; así como quedarse en casa cuando se tiene un síntoma de alguna enfermedad respiratoria.
No obstante, a las medidas sanitarias impuestas, y a efecto de reducir la propagación de contagios, tanto la Administración Pública como la Iniciativa Privada han optado por implementar el llamado Home Ofiice, el cual consiste en que la fuerza laboral, disponga y utilice las bondades tecnológicas para realizar sus actividades cotidianas, y con ello evitar salir de casa.
En este sentido, es de vital observancia que, de acuerdo con la Ley Federal de Protección de Datos Personales en Posesión de los Particulares, así como la Ley General de Protección de Datos Personales en Posesión de Sujetos Obligados, todo responsable del tratamiento de datos personales debe establecer y mantener medidas de seguridad administrativas, técnicas y físicas que permitan proteger los datos personales contra daño, pérdida, alteración, destrucción o el uso, acceso o tratamiento no autorizado.
Así, y toda vez que en muchos de los casos los responsables deben llevarse a casa expedientes o documentos para facilitar el avance del trabajo, o bien, acceder remotamente a los servidores de la empresa, es necesario tomar conciencia de la importancia de salvaguardar los datos de las personas, ya que, con ello no solo se protege información de esta, sino que lleva inmersa la privacidad, la dignidad y la honra de la persona.
Es por ello que, se sugieren las siguientes medidas: 2
- Hacer del conocimiento de los trabajadores la responsabilidad que tienen como sujetos intervinientes en el tratamiento (como responsables o encargados) de la información y los datos personales, sobre todo cuando se realiza una remisión o transmisión de los mismos.
- Proteger en todo momento la integridad, confidencialidad y disponibilidad de la información, así como de los datos personales.
- Utilizar equipos de cómputo proporcionados por el empleador, o en su defecto, instalar todas las medidas de seguridad en los equipos personales del trabajador, como antivirus, filtros de contenido, sistemas de detección de intrusos que eviten malwares o algún tipo de programa que pueda vulnerar o amenazar la seguridad de los datos y en general de la información contenida en el dispositivo electrónico.
- No utilizar cuentas de correo electrónico ajenas a la empresa, ni abrir correos desconocidos que pudieran tener un malware o software malicioso.
- En caso de sufrir un ataque por un malware que invada, dañe o deshabilite el ordenador o sistemas informáticos, se cuente con un respaldo o copia de la información.
- Tomar las medidas necesarias para evitar que personas no autorizadas tengan acceso a los datos personales y a la información.
Conforme a lo anterior, es de vital importancia, entender que, en la presente emergencia sanitaria, no solo se trastoca la salud de las personas, sino que existen otros derechos que pueden ser vulnerados, como es el derecho a la privacidad y que, de obviar acciones para evitarlo, se puede producir un daño de imposible de reparación tanto para las personas como para los responsables del tratamiento, pues menoscaba la credibilidad institucional.
Con ello recuerda, la protección de datos personales está en tus manos.
